In a notable case at the Federal Court of Canada for our client, we represented an Iranian family—a father (Mohammad), mother, and young daughter—each applying for permits to join Mohammad on his study permit. His wife applied for a work permit, and his daughter for a visitor visa. Yet, all three applications were denied, as the officer rejected Mohammad’s permit and subsequently those of his family members.

The grounds for refusal?
The officer’s notes explained that the family’s plans to travel together diminished their motivation to return to Iran. Additionally, stated that Mohammad’s letter of support from his employer didn’t mention the necessity of international education in detail.

We sought a judicial review. We highlighted that the officer’s decision is unreasonable, arguing that the officer ignored substantial evidence of Mohammad’s ties to Iran, including family, property, and employment. The officer also overlooked the employer’s salary increase offer, which directly supported Mohammad’s educational purpose.

Our strong Memorandum of Arguments persuaded the judge to permit us to proceed to a court hearing. At the hearing, we fought for Mohammad’s case in the Federal Court and demonstrated that the officer’s decision disregarded key evidence, rendering it unreasonable.
The outcome of the Hearing
Ultimately, the Federal Court ruled the decision unreasonable and ordered a fresh review by a new decision-maker, giving the family renewed hope for their plans in Canada.
Masoud, a successful 40-year-old business owner from Iran, applied for a visitor visa to reunite with his wife, who was living in Canada.

After thorough legal prep and some back-and-forth, IRCC stepped in with a settlement offer. Masoud’s perseverance and our team’s dedicated efforts led to a successful resolution. Instead of pushing forward to a full court ruling, they agreed to re-assess Masoud’s case, recognizing the issues with the original officer’s decision.
On May 10, Masoud received a request letter from IRCC to send the updated documents for his application.
